On November 10, 2023, Anthony Panebianco was quoted in the Massachusetts Lawyers Weekly article, “Failure-to-rehire suit against MIT avoids dismissal.” The article covers the case of Cafarella v. Massachusetts Institute of Technology. In the case, the plaintiff, a former MIT office manager, alleged that he was told he was being terminated because his position was being eliminated, and could proceed with retaliation claims based on a failure to rehire.

Panebianco said Cafarella raises the question of whether going forward it is advisable for employers to continue to insist on language in settlement agreements under which the employee agrees not to seek further employment with the employer.
