It is with great sadness that we announce the passing of our dear friend and colleague, Thomas S. Fitzpatrick. Tom practiced at Davis Malm for 31 years and served as President between 2009-2014.

“Tom was one of the finest, most creative, zealous and highly respected litigators in the history of Davis Malm – and in the Commonwealth – who consistently displayed great confidence, amazing perseverance and unmatched advocacy skills,” said Davis Malm President, Amy Fracassini. “His wisdom, wit and leadership will be greatly missed and will forever be an integral part of our firm.”

Tom began his career at Davis Malm as an associate, and his skills and talents quickly propelled him to a leadership role in the firm. He was a key member of the team that represented family members in one of the longest running and most contentious disputes in Massachusetts history. For over two decades, Tom prevailed time and time again, litigating against numerous national firms and dozens of lawyers. He was instrumental in the success of this landmark case, which set precedents in Massachusetts law, in the areas of fiduciary duties and fiduciary claims. No matter the size of the client, the complexity of the issues or the amount at stake, Tom treated every client and approached each case with great attention, focus and respect.

Tom was an advocate for many community outreach initiatives, including the Boston Police Foundation, the Salvation Army and the American Heart Association, among others. A consummate organizer, Tom enjoyed bringing together colleagues and friends to socialize and support worthy causes. While he was always the heart of the event, he never commanded the spotlight.

Tom earned a J.D. from Northeastern University School of Law in 1990 and a B.A. from Holy Cross in 1984.
