On July 29, 2022, Shawn McCormack was quoted in the Massachusetts Lawyers Weekly article, “Buyers can enforce offer to purchase vacation home.” The article covers the recent U.S. District Court decision in Ritter v. Johnson. In the case, Judge Denise Casper found that an offer to purchase a Martha’s Vineyard property was a binding and enforceable contract, even though the seller argued that the parties had not agreed to material terms of the deal.

In my experience representing buyers, [they] have the expectation that once their offer is accepted, they basically have a deal. In most of the case law, it’s usually the seller who’s trying to back out.
