Allison Ahern Fillo recently authored an article published by HR Executive, “Immigration Shakeup: What Recent Changes Mean for Hiring Foreign Talent.” She discusses the most recent changes in immigration law, regarding the pause on visa issuance, the shift in the H-1B lottery weighted selection process, and how these factors are impacting the hiring process for employers within the U.S.

Allison talks about how immigrant visa issuance for nationals of 75 countries applies only to individuals outside the U.S. seeking green cards through consular processing and does not affect temporary work visas or applicants adjusting status within the U.S. She states that employers should note that the pause is limited in scope and exempts dual nationals of non-listed countries. Meanwhile, the annual H-1B lottery has shifted from a fully random system to a weighted selection process that gives higher chances of selection to candidates offered higher wages within Department of Labor wage levels. As a result, employers must more strategically evaluate job classifications and compensation structures to improve their odds in the increasingly competitive H-1B selection process.
