On September 16, Courtney A. Simmons presented, “The Duty of Care Balancing Act,” on the New England Chapter of the Community Associations Institute’s (CAI-NE) Lunch & Learn webinar.

Based on her article published in CAI-NE’s publication, Condo Media, Courtney covered the Massachusetts Appeals Court decision in Arslen v. Kettle Brook Lofts Condominium Trust. The Superior Court determined that a condominium association can regulate activities in the common areas through its rules and regulations; however, those rules must be reasonable to be valid and enforceable against unit owners, particularly if the restrictions impede an owner’s use of a unit. Courtney discussed the condominium association’s role in ensuring resident safety while also respecting unit owners’ rights, and what steps associations and unit owners should take now.

“Finding the right balance between protecting residents and avoiding overreach is not always easy, but it is a critical responsibility for condominium associations,” said Courtney. “I’m grateful to Condo Media for the opportunity to write about this important issue, and to the Lunch & Learn platform for allowing me to engage directly with boards and owners on practical steps they can take to navigate these gray areas with confidence.”
