On March 29, 2005, Tom Fitzpatrick won a case in which he was defending a bank, its mortgage company subsidiary and one of its loan officers. The plaintiff in the case claimed that the defendants had committed fraud and violated M.G.L. Chapter 93A in connection with a construction loan. On the second day of trial in the Suffolk Superior Court, Tom obtained a critical evidentiary ruling that forced the plaintiff to concede. The Court then allowed motions for a direct verdict for the defendants on the fraud claim, as well as the other common law counts, and for dismissal of the Chapter 93A claim.
