On October 31, 2019, Robert Kaitz was quoted in the Massachusetts Lawyers Weekly article, “Eye doctor cannot sure under Wage Act after practice breakup.” The article outlines the Appeals Court decision in O’Connor v. Kadrmas. The court decided that an ophthamologist, following the breakup of his Plymouth practice, could not proceed with a claim for treble damages under the Wage Act.

‘O’Connor falls in line with decisions narrowly construing the Wage Act, said Robert M. Kaitz. “The courts have repeatedly narrowly construed what is a ‘wage’ under the Wage Act,” the Boston employment attorney said. “That’s primarily because it has such a powerful damages mechanism.”’
