Emily is a passionate litigator focused on complex commercial disputes and employment matters. Emily has represented businesses, municipalities, and individuals in a wide variety of disputes before state and federal trial and appellate courts, government agencies and in alternative dispute resolution. Her litigation practice concentrates on business torts and contract disputes, close corporation conflicts, employment discrimination, restrictive covenants, and wage and hour issues.

In addition to her litigation practice, Emily is a trusted advisor to employers and professionals on a variety of employment issues and related risk management strategies. Emily also conducts workplace investigations arising from discrimination and harassment complaints.

  • Obtained dismissal of employment-related federal civil rights claims brought against a Boston Police Department Captain and the Department’s legal counsel by a police detective.
  • Conducted an independent workplace investigation of misconduct allegations against a high-level municipal official.
  • Successfully represented a defendant higher education institution executive and officer on a motion to dismiss in a federal class action suit claiming breach of contract and fiduciary duty, among other claims. Prevailed on appeal in the First Circuit Court of Appeals.
  • Regularly represent employers and secure favorable decisions in connection with proceedings before the Massachusetts Commission Against Discrimination and the Equal Employment Opportunity Commission.
  • Provide regular employment counseling to businesses and human resources professionals, including drafting employment documents and advising on compliance with wage and hour and equal employment opportunity laws.
  • Successfully defended owner of housing complex in Massachusetts Court of Appeals, affirming trial court’s dismissal of would-be buyer’s breach of contract claims.
  • Secured multiple favorable dispositions on behalf of attorneys in suits alleging legal malpractice.

(2020) – Obtained dismissal of employment-related federal civil rights claims brought against a Boston Police Department Captain and the Department’s legal counsel by a police detective. The court found that the plaintiff brought his claims after the statute of limitations had expired, rejecting his argument that the delay was legally justifiable.
  • Tristan Squeri, et al v. Mount Ida College, et al., 954 F.3d 56 (1st Cir. 2020) – Successfully defended higher education institution’s executive and officer against appeal of the district court’s dismissal of a class action suit claiming breach of contract and fiduciary duty.
