Special-Needs Planning
Our trusts and estates attorneys regularly work with clients with special needs and their families to develop sound plans for short-term and long-term financial security. We know from extensive experience how crucial it is for individuals with special needs and their families to create, fund, and implement effective plans to meet the disabled individual's unique requirements.
We have crafted a number of different types of special-needs trusts for a variety of clients, and we provide comprehensive counseling on administration, selection of a fiduciary, funding, investment strategies, and distributions. We always plan for the inevitable changes in the needs of disabled persons as time passes, making sure that we build into each plan as much flexibility as possible.
Our attorneys frequently serve as fiduciaries for clients with special needs. We determine carefully how to retain our clients' eligibility for available state and federal benefits, administering the trust to ensure that distributions have as small an impact on eligibility as possible.
Our attorneys have lectured widely and written frequently about special-needs planning issues and solutions. We are proud that one of our attorneys serves as a member of the Board of Directors of Massachusetts Advocates for Children and also serves as cochair of the Elder and Disability Law Committee of the Trusts and Estates Section of the Boston Bar Association.
Representative Matters
- Represent a disabled man whose disability has led him and his family to improve access to services for the disabled. Most recently, he started a website, http://thetravelingwheelchair.com/, where visitors can write reviews and rate local venues on their wheelchair accessibility.
- Created an estate plan for the parents of a disabled child that is sensitive to the child's possible ongoing need to qualify for public benefits.
