Probate Litigation and Guardianship Proceedings
A carefully crafted estate plan may minimize the publicity and expense of the probate process as well as disputes when a loved one dies. When such disputes do arise, our probate attorneys have the skills and experience to resolve them. We have extensive expertise in all types of such disputes, including contested wills, trust restructuring, guardianships proceedings, financial conservatorships, fiduciary accountings, and other claims that may arise.
We always work with our clients during this difficult time to resolve probate matters as quickly and efficiently as possible. We recognize that these matters are often emotionally charged and complex. Disputed probate matters also nearly always require creative, technical, and practical solutions. Our seasoned probate litigators have the expertise, temperament, and analytical focus to approach these issues with both reason and skill.
We also regularly represent parties involved in petitions for guardianship and conservatorship. We represent fiduciaries of all types, thus minimizing litigation by educating them as to their duties and working with them to fulfill their responsibilities. We also are experienced in handling litigation that does arise involving fiduciaries.
We recognize that mediation or other forms of negotiated resolution are frequently in our clients' best interests in estate matters. We are experienced in preparing for and participating in this process, and have a record of success in these forums as well.
Our probate litigators frequently lecture at continuing legal education programs for members of the bar. We are also often chosen to represent attorneys when they are acting in a fiduciary capacity and are in need of counsel, a record of which we are especially proud, as it shows our colleagues' respect for our work.
