
On November 3, Davis Malm attorneys Laurie Alexander-Krom and David M. Cogliano conducted an employment law workshop for the Northeast Human Resources Association (NEHRA) on "How to Handle Usual and Unusual Leave Of Absence Requests." The workshop provided an overview of the various laws that may be applicable when employees request leave of absences including the Family Medical Leave Act, Americans with Disabilities Act, and Title VII. In addition to common situations, such as maternity leave, illness, or injury, Ms. Alexander-Krom and Mr. Cogliano explored more difficult scenarios, such as leaves for mental illness, infertility treatment, substance abuse treatment, and situations in which leaves are lengthy, undetermined in length, or where multiple leaves are requested. The workshop also addressed how employers should handle all leave of absence requests in order to avoid costly mistakes, and what information the employer can or should request prior to approving the leave.
