The Land Use and Real Estate Group at Davis Malm has a complete and varied real estate development, land use and transactional practice. The group's practice involves all aspects of residential and commercial development, including permitting and appeals, other land use litigation, conveyancing, commercial leasing, the establishment of condominiums and the representation of condominium associations, as well as foreclosures. We have handled large commercial lease transactions for both landlords and tenants. We often appear before local planning boards, boards of appeal, conservation commissions and other local and state agencies. We advise our clients with respect to compliance with local and state regulations and work with local communities on our clients' behalf through the permitting process. Davis Malm is among the foremost firms in Massachusetts in the litigation of land use disputes, including:
- Zoning appeals
- Subdivision appeals
- Zoning enforcement actions
- Wetland appeals
- Boundary and quiet title disputes between property owners
- Land registration actions
- Specific performance cases and other disputes over the sale and purchase of real estate
Often, local counsel for developers ask us to become involved when litigation appears unavoidable. We have a winning track record litigating land use disputes in the Massachusetts Land Court, the Superior Court and at appellate levels. The group recently made new law when the Supreme Judicial Court recognized the right of a buyer to rely on an accepted written offer to purchase as a binding agreement. In another recent case of first impression, the Supreme Judicial Court established on behalf of our client the right of private parties to appeal decisions of the Boston Redevelopment Authority upon the granting of a building permit.
