

Practice Focus and Experience
Neal Bingham practices in the Litigation Group, the Closely Held Business Group, and the Real Estate Group. Neal's practice focuses primarily on business and commercial litigation. He has extensive experience in a variety of complex civil litigation in state and federal court involving claims arising out of real estate development, shareholder disputes, and the operation of residential and commercial condominiums.
While in law school, Neal interned with the Hon. Robert B. Collings, Chief Magistrate Judge in the United States District Court for the District of Massachusetts, and with the Boston law firms of Ross, Martel & Silverman LLP, Latronico, Black & Whitestone, as well as with Davis Malm.
Representative Matters
- Defense of residential and commercial property owners from contractors' construction claims seeking payment for unworkmanlike construction.
- Defense of trustees of condominium trust from claims of breach of fiduciary duty and self-dealing in connection with condominium management.
- Representation of numerous condominium associations in the collection
of outstanding condominium common expenses from delinquent condominium
unit owners under G.L. c. 183A.
- Lawsuit seeking damages arising out of commercial lessee's failure to take possession of leased real estate of make payments under a commercial lease.
- Defense of produce packaging company from a breach of contract claim
arising out of the purchase of automated packing equipment.
- Lawsuit seeking specific performance of an agreement for the purchase
and sale of stock in a closely held corporation.
- Lawsuit seeking specific performance of an agreement to provide an
investor with a percentage of closely held corporation, raising allegations
of breach of contract, misrepresentation and self-dealing.
- Numerous lawsuits seeking to collect damages on breached equipment
lease contracts.
- Defense of residential and commercial landowners from complaints asserting adverse possession and extinguishment of easement rights.
- Defense of a high-end lighting designer from a complaint alleging breach
of contract, interference with contractual relations, defamation and violations of G.L. c. 93A.
- Defense of corporate lessee from allegations of waste and property
damage during the lease term.
- Representation of a 50% shareholder of a Massachusetts corporation
seeking to dissolve the corporation due to a deadlock of the board of
directors.
